OtoWakacje.com – an online classified ads site owned and administered by Grupa Allegro Sp. z o.o., making it possible to publish travel offers and accommodation to rent ads as well as any other offers connected with the travel industry. Any references hereinafter to otoWakacje.com shall be deemed to mean also Grupa Allegro Sp. z o.o.
Grupa Allegro – Allegro Group Sp. z o.o with the registered office at ul. Marcelińska 90, 60-324 Poznań, entered into the Register of Entrepreneurs kept by the District Court for Poznań – Nowe Miasto i Wilda in Poznań, 8th Commercial Department of the National Court Register under KRS number 0000268796, share capital of 33,474,500 PLN, tax identification number NIP: 527 25 25 995.
Ad – a place temporarily made available to the User on otoWakacje.com, allowing the User to present travel offers or accommodation to rent ads or any other offers of goods and services connected with the travel industry. The Ad cannot include contents commonly considered offensive or insulting, satisfying criteria of an act of unfair competition, detrimental to otoWakacje.com as well as any other contents forbidden by law.
User – a natural or a legal person and an organisational unit without legal personality that agreed to be bound by the contents hereof.
Price list – fees determined by otoWakacje.com for publishing ads or using the platform in any other form, paid by the User the moment of publishing an Ad (Annex no. 1).
Date of execution – the moment of establishing a legal relationship between a User and otoWakacje.com as defined herein.
Date of performance – the moment when otoWakacje.com starts performing a service of Ad publication.
Terms and Conditions – this document drafted by otoWakacje.com, determining the operations and rules of using the site.
Subdomain – a website bought by the User in the otowakacje.com domain, being a User’s business card.
Art. 2 Rules of system operations
OtoWakacje.com shall not be a party to agreements on provision of travel services, but shall only provide a technical platform allowing the transaction parties to contact each other.
OtoWakacje.com shall not be held liable for damages arising out of any transactions or for conduct of the parties during their finalization process.
OtoWakacje.com shall not act as an intermediary in any disputes between parties to the transaction. Any disputable issues shall be settled by the parties themselves.
OtoWakacje.com may only be used to publish contents compliant with the applicable Polish laws.
Art. 3 Terms of use
The User of otoWakacje.com may only be a person over 18 years of age, having full capacity to acts in law as well as a legal person or an organisational unit without legal personality.
To be able to use otoWakacje.com, the User shall accept the contents hereof.
Ads may only be published on otoWakacje.com by registered Users.
A subdomain is a solution addressed for Users having a company account on otoWakacje.com.
Art. 4 Terms of publishing ads
The User shall be held liable for published contents and in particular represents that they comply with the actual situation and the legislation in force as well as that they do not infringe the provisions hereof and any rights of third parties. OtoWakacje.com shall not be held liable for Users’ activities, in particular for authenticity, reliability and compliance of the published contents with the provisions of applicable laws.
OtoWakacje.com reserves the right to discontinue the provision of services, in particular to remove the Ad that infringes in any way the provisions hereof, especially when it includes contents commonly considered offensive or insulting, satisfying criteria of an act of unfair competition, infringing copyrights of third parties, detrimental to otoWakacje.com, misleading other Users as well as any other contents forbidden by law. In such case the User shall not be refunded any fees for publishing the Ad.
The User represents to hold copyrights to the published contents, including photos, and consents that they may be used by otoWakacje.com as well as by its affiliate company Grupa Allegro Sp. z o.o. on online platforms administered by them and in any other media such as press, TV, banners, billboard and the Internet.
Ads shall be published on otoWakacje.com for free.
The Ad shall be published on condition of filling out the Ad form correctly, in particular its obligatory part.
The User may publish photos in the Ad, relating to its subject matter, using the form available on the site. It is forbidden to place photos in the Ad, not relating to the service offered by the User, in particular the ones that aim at promoting the company, brand, logo of the advertiser or any third party.
OtoWakacje.com shall not be held liable for delays in delivering text messages due to the fault of mobile phone operators.
OtoWakacje.com shall not be held liable for any technical problems caused by partners of otoWakacje.com.
At User’s request, the Ad may be promoted on the main page for an additional fee. This option shall apply only to Ads with photos. The order of publishing Ads on the main page is random.
The Ad shall be published not later than 1 hour after the User has complied with all the formalities required for its publication defined in art. 4 (5).
The Ad may be published only by Users having their own accounts on otoWakacje.com. It is forbidden to publish an Ad with the same offer several times.
Failure to make a payment due within the stipulated term may result in deactivation of some or all functionalities on User’s Account. In such case the Account may be restored its full functionality only on condition of making an immediate payment of all amounts due to otoWakacje.com.
OtoWakacje.com reserves the right to change the category of an Ad if it was placed in an incorrect one, without informing the person publishing the Ad about it.
OtoWakacje.com shall not be held liable for contents of Ads or Users’ conduct as well as for truthfulness and reliability of Ads published on the site.
Art. 5 Withdrawal from agreement
The User being a consumer is entitled to withdraw from the agreement with otoWakacje.com not later than within 10 days from its conclusion.
Due to the character of services offered on otoWakacje.com, the moment the site starts providing it, the User shall lose the right to withdraw from the agreement if User publishes an Ad within 1 hour after having complied with all the formalities defined in art. 4 (5).
In the event the User resigns from using a Subdomain before the expiry of 1 year from its activation date, the User shall not be entitled to be refunded funds for the missed period of time.
Art. 6 Complaints procedure
The User shall be entitled to lodge a complaint for the inaccurate performance of the service within 7 days from the end date of Ad publication.
Any complaints shall be lodged to otoWakacje.com to the following e-mail address: reklamacje@otowakacje.pl or by mail to the address of otoWakacje.com.
The complaints shall be considered without due delay, however, not later than within 14 working days from the date of their receipt.
Art. 7 Processing of data
As a result of participation in the system, the User may provide his personal data in the Ad, which will allow for establishing contact with him. The Ad shall be placed only on condition of providing at least User’s e-mail address.
Personal data shall be processed by Grupa Allegro Sp. z o.o. being a Data Administrator for the purposes connected with the provision of services. Data shall be processed pursuant to the Act on Processing of Personal Data and the Act on Providing Services by Electronic Means.
The set of Users’ data has been submitted for registration by the Polish Inspector General for Personal Data Protection – GIODO and has been entered into the national registry of personal data sets under number 063212. A Data Administrator is Grupa Allegro Sp. z o.o.
The User shall be entitled to review and edit his data or request it to be removed.
By submitting his data, the User agrees to have it transferred to third parties performing activities as per the order of otoWakacje.com within the scope of this service.
Art. 8 Amendments to price list and Terms and Conditions
These Terms and Conditions as well as the price list may be changed by otoWakacje.com. Any amendments hereto as well as their application dates shall be published by otoWakacje.com at www.otowakacje.com.
The amendments hereto and to the price list shall become effective not earlier than within 3 days from their publication on the website.
